Orders:

When you place an order, we will require your name, e-mail address, credit / debit card number and card expiry date. Without this information we will not be able to process your request or notify you of acceptance of your order.
A contact telephone number is also required so that we may reach you if there is a problem with your order. We may, unless you advise us otherwise, pass this information to our couriers or other agents in case they need to contact you to arrange the processing or delivery of your order.
As part of our efforts to ensure that you are aware of the latest developments and offers, we may also use this information to advise you of new products, special offers or changes to our site. If you would rather not receive this information, please send an email to customerservices@hutchinsonexclusive.com. Once your order has been despatched, the completion of the contract between Hutchinson & Co and yourself takes place. We cannot fulfil any obligations due to the following reasons:

• The product you ordered being unavailable from stock
• Our inability to obtain authorisation for your payment
• The identification of a pricing or product description error
• Customers who fail to reach any order criteria set out in the Terms & Conditions

If there are any problems with your order, you will be contacted by one of our Customer Service Representatives either by email or by phone.

We reserve the right to reject any offer of purchase by you at any time. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure; however in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Contract Cancellation

Please note that you are entitled to cancel this contract if you so wish, provided you exercise your right no longer than eight working days after the day on which you receive the products. If you wish to exercise your right to cancel this contract prior to order despatch, please contact our customer services department on customerservices@hutchinsonexclusive.com. If your order has already been despatched please follow the procedure set out in our Returns Policy.

Product pricing & descriptions

Each product purchased is sold subject to its Product Description. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information, including product descriptions, appearing on this Website at a particular time may not always reflect the position at the exact moment you place an order.

Sale Item Disclaimer

We may have very limited stock of our sale items from time to time, and we will not be taking back orders on any of these items. Due to the fact our stock levels are updated once every 24 hours a product may sell out during time you have placed your order and when we try to fulfil it. If this does happen we will contact you within 3 days with an alternative item or refund your money.

Bespoke Items

Bespoke items will be commissioned specially for you. You will receive personal consultation until you give us the confirmation to place the order. Please sign it and return it to us immediately so we can progress with your order. You may cancel your order at no cost before you sign your confirmation, however, any cancellations after you have signed the confirmation will incur a 30% cancellation fee.

Payment

Payment for all orders is at point of sale and not at point of despatch

All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold;

To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:

• Register by providing your real name, phone number, e-mail address, payment details and other requested information
• Be over 18 years of age
• Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
• Possess a valid credit or debit card issued by a bank acceptable to us

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

You must not misuse this Website. Hutchinson & Co will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.
 
Intellectual Property, Software and Content

You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
All prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

Governing Law and Jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

Information about the Website

We try to make sure that all information on the Website, including descriptions of our Goods, and listed prices, are accurate and correct at all times. However, mistakes do happen. We will try to resolve all information errors on the Website as soon as reasonably possible, and if we reasonably think that such an error has affected your purchase of Goods we will try to let you know. However, because we take these steps we will not be liable to you for any errors on the Website.
You should bear in mind that buying clothing and accessories over the internet provides a different shopping experience to buying in-store. In particular you acknowledge that:

• the colours which are shown for the Goods on the Website will depend on many factors – including your display settings;
• all sizes and measurements are approximate;
• all Goods are subject to availability - we may not be able to supply your order;
• any delivery estimates given on the Website or by email are estimates only;

You are responsible for ensuring that your login details, password and all other details in relation to your account remain confidential at all times.


Pre-Ordering Goods

Products for sale are in stock and available for despatch from our distribution centre. Occasionally, however, we may be waiting for shipments from our designer suppliers. Consequently you may from time to time be given the possibility of making an Advance Payment for certain items in which case you are able to make an Advance Purchase. This will ensure that you receive this item in priority once designer stock has been delivered. We will not always be able to deliver Advance Purchase within 30 days of the date you place your order. The Website will specify when we expect the Advance Purchase Goods to become available but this is an indication only and we will not be obliged to despatch the Advance Purchase Goods to you within this time as problems with new products can occur and suppliers may let us down.
As with all Goods, an offer made by you to purchase Advance Purchase Goods shall only be deemed to be accepted by us when we despatch the Goods to you and send you an Order despatch email.

Items received into stock may be pre-allocated to satisfy Advance Payment orders and customers making Advance Payments will receive items in priority to customers on the Waiting List or customers ordering through the Site for immediate delivery. Please be aware that we may be unable to deliver selected Advance Payment merchandise due to production problems or quality check issues identified when we receive an order into stock. In these circumstances we will notify you by email and refund the Advance Payment to your credit card within thirty days of being advised that merchandise has become unavailable.

If you have registered your email address for notification of the arrival of a specific product featured on our website, we will attempt to notify you by email within 48 hours of the product becoming available on the site. Please note that on occasion certain products that are in particularly high demand will sell out during this period.

Prices shown on the site are in GBP and are inclusive of VAT unless an alternative country has been selected by the customer, as indicated in the top left hand corner of the website.

Faulty goods

Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within six months of purchase. Please note that items that are damaged as a result of wear and tear are not considered to be faulty.
If you would like to exchange a faulty item, please be aware that we can only replace it for the same product in the same size, subject to availability. Where possible, we will offer to repair faulty items.
